These Terms and Conditions ("Terms") govern your use of the website www.pilotaudio.com.au ("Website") and the purchase of any digital courses, content, or services offered through it ("Services"). The Website is operated by Pilot Audio Pty Ltd ("we", "us", "our"), a company registered in Queensland, Australia.

By accessing the Website or purchasing any Services, you agree to be bound by these Terms. If you do not agree, please do not use the Website or purchase any Services.

We may update these Terms from time to time. The most current version will always be available on this page with the "Last updated" date shown above. Your continued use of the Website after changes are posted constitutes acceptance of the updated Terms.

2. Services

2.1 We provide digital aviation theory courses, including audiobook content, audio practice exams, and written practice exams, delivered through an online learning platform hosted at www.pilotaudio.com.au.

2.2 Our courses are educational study aids designed to help you prepare for Civil Aviation Safety Authority (CASA) theory examinations. We do not guarantee that completing a course will result in you passing a CASA exam. Exam outcomes depend on many factors including your individual preparation, flight training, and familiarity with permitted exam materials.

2.3 We are not a CASA-approved training organisation and our courses do not constitute formal flight training. Our courses are supplementary study resources.

3. Accounts

3.1 To purchase and access our Services, you must create an account. You agree to provide accurate information when creating your account and to keep your details up to date.

3.2 You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account. If you believe your account has been accessed without your permission, contact us immediately at support@pilotaudio.com.au.

3.3 We reserve the right to suspend or terminate your account if we reasonably believe you have breached these Terms.

4. Orders and Payment

4.1 Prices for our Services are displayed on the Website in Australian dollars and are inclusive of GST where applicable.

4.2 When you place an order, you are making an offer to purchase. A binding agreement is formed when we confirm your order by sending a confirmation email.

4.3 Payment is processed at the time of purchase through the payment methods available on the Website. Access to the course is provided immediately upon successful payment.

4.4 We reserve the right to change prices at any time. Price changes do not affect orders that have already been confirmed.

5. Refund Policy

5.1 Change of Mind Because our courses are digital products available immediately upon purchase, we do not offer refunds for change of mind once you have accessed the course content. Audiobook chapters, audio practice exams, and written practice exam questions cannot be returned once consumed.

If you have purchased a course but have not yet accessed any course content, you may request a full refund within 7 days of purchase by contacting us at support@pilotaudio.com.au.

If you purchased the wrong course (for example, you bought one subject but meant to buy another), please do not start the course. Contact us immediately at support@pilotaudio.com.au and we will swap you to the correct course or issue a full refund, provided you have not accessed any content.

5.2 Faults and Technical Issues Our products come with guarantees that cannot be excluded under the Australian Consumer Law. If the course has a major fault — for example, if significant portions of the content fail to load or the course is materially different from what was described — you may be entitled to a replacement or refund regardless of how much content you have accessed.

If you experience a technical issue, please contact us at support@pilotaudio.com.au with as much detail as possible. We will work to resolve the issue as soon as practicable. If we are unable to resolve a genuine fault, we will provide a full refund.

5.3 Cancellations You may stop using a course at any time. However, ceasing use does not automatically generate a refund for a previous purchase if the content has already been accessed.

6. Australian Consumer Law

6.1 Our Services come with guarantees that cannot be excluded under the Australian Consumer Law ("ACL"), which is set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

6.2 Nothing in these Terms purports to exclude, restrict, or modify any consumer guarantee, right, or remedy conferred by the ACL or any other applicable law that cannot be excluded, restricted, or modified by agreement.

6.3 To the extent permitted by law, our liability for breach of any implied warranty or condition that cannot be excluded is limited to the re-supply of the Services or the payment of the cost of having the Services re-supplied.

7. Intellectual Property

7.1 All content on the Website and within our courses — including text, audio, graphics, logos, images, software, and course materials — is owned by Pilot Audio Pty Ltd or our licensors and is protected by the Copyright Act 1968 (Cth) and other applicable intellectual property laws.

7.2 When you purchase a course, you are granted a personal, non-exclusive, non-transferable licence to access and use the course content for your own private study purposes only.

7.3 You must not:
  • Copy, reproduce, distribute, share, or make available any course content to any other person;
  • Record, download (except where explicitly provided), or capture any audio or other course content;
  • Upload course content to any other platform, website, or file-sharing service;
  • Use course content for any commercial purpose;
  • Remove or alter any copyright notices or branding within the course content.


7.4 A breach of this clause may result in termination of your account without refund and may give rise to legal action.

8. Accuracy of Content

8.1 We make every reasonable effort to ensure the accuracy and currency of our course content, including alignment with the current CASA Part 61 Manual of Standards syllabus.

8.2 However, aviation regulations, procedures, and exam formats can change. We do not guarantee that all content will be current at the time you access it. Students should always verify critical information against the latest CASA publications and legislation.

8.3 Any information provided in our courses is for educational purposes only and does not constitute legal, regulatory, or professional advice.

9. Website Availability

9.1 We use reasonable efforts to ensure the Website and our learning platform are available and functioning. However, we do not guarantee uninterrupted or error-free access. The Website may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

9.2 We are not liable for any loss or inconvenience caused by temporary unavailability of the Website or platform, except where such unavailability constitutes a major failure under the Australian Consumer Law.

10. Limitation of Liability

10.1 To the maximum extent permitted by law, our total liability to you for any claim arising out of or in connection with these Terms or your use of our Services is limited to the amount you paid for the relevant course.

10.2 To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of data, or failure to pass a CASA examination.

10.3 Nothing in this clause excludes or limits our liability for:
  • Fraud or fraudulent misrepresentation;
  • Any liability that cannot be excluded or limited under the Australian Consumer Law or any other applicable law.

11. Privacy

12. Use of the Website

14.2 If we terminate your account due to your breach of these Terms (including the intellectual property provisions in Clause 7), you are not entitled to a refund.

14.3 You may close your account at any time by contacting us at support@pilotaudio.com.au. Closing your account does not entitle you to a refund for courses already accessed.

15. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Pilot Audio Pty Ltd in relation to your use of the Website and purchase of Services. They supersede all prior agreements, representations, and understandings.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Queensland and the Commonwealth of Australia. You and Pilot Audio Pty Ltd submit to the non-exclusive jurisdiction of the courts of Queensland and any courts entitled to hear appeals from those courts.
